The Colombian Civil Code regulates the theory of risk in the contractual relationships that arise from the sale. The buyer is not the owner and bears the fortuitous loss of the thing, having to execute the payment provision knowing that the debtor will not meet theirs, in a situation that threatens the contractual balance of act. The theory is taken from French law, George Ripert (n. d) and adopted by the Colombian law. It is proposed that the cause of the (...) contract, element of formation, and execution of the act is accepted in order to restrict the threat that puts the legal stability of the act at risk. El amor es sentimiento, afecto, inclinación y entrega a alguien, mientras que la obsesión es una perturbación anímica producida por una idea fija. Sentimiento y perturbación son cosas distintas y producen comportamientos bien diferentes. Sin embargo, el amor puede experimentarse como una idea con tenaz persistencia y como un deseo incontrolable.

A partir de un enfoque filosófico interpretativo, este texto tiene por objetivo estudiar los alcances y limitaciones del modelo de lectura crítica propuesto por el Ministerio de Educación Nacional de Colombia. Para abordar lo anterior, en primer lugar, se estudia cómo están diseñadas las pruebas de lectura crítica y qué significa interpretar un texto; en segundo lugar, se analiza la importancia de la lectura crítica para el fomento de la sabiduría práctica, y, en tercer lugar, se responde por qué es (...) importante concebir la lectura como experiencia formativa desde perspectivas creativas y plurales. Este artículo examina las diferentes conceptualizaciones del sistema cognitivo de los docentes, desde la perspectiva socioconstructivista. Aborda la cognición como una base conceptual, personal, subjetiva y dinámica que tiene un impacto significativo en la actuación docente y en el proceso de cambio en educación. El proceso de exploración de la cognición docente puede ayudar a enriquecer la conceptualización sobre el proceso didáctico, y, además, puede servir como base para la autoevaluación docente, componente importante del desarrollo profesional en la Educación Superior.

Propósito: la adecuación del esfuerzo terapéutico es una decisión clínica basada en la evidencia que pretende evitar la futilidad médica. Se han señalado diferentes factores que pueden influir en esta toma de decisiones los cuales se relacionan con el paciente, el profesional médico que toma de las decisiones, barreras del sistema, cultura y economía, entre otros. El presente estudio pretende identificar aquellos factores que influyen en los médicos especialistas que laboran en la institución referente del cáncer en Colombia, a fin (...) de planear acciones que mejoren el abordaje de la toma de decisiones con respecto a la adecuación del esfuerzo terapéutico en pacientes con cáncer. Metodología: diseño cualitativo basado en 13 entrevistas en profundidad a médicos especialistas del Instituto Nacional de Cancerología de Colombia. Resultados: participaron 3 mujeres y 10 hombres, con un promedio de edad de 36 años, 7 pertenecientes a la especialidad de oncología de adultos, 2 a oncohematología pediátrica, 1 a cuidados intensivos de adultos y 3 a cuidados intensivos pediátricos. Los factores hallados se agruparon en cuatro categorías: 1) conocimiento, 2) aspectos relacionados con la toma de decisiones, 3) quién decide, 4) tipo de decisión que se toma; a su vez, estas categorías se agruparon en temas que hacen alusión a los factores que influyen en la toma de decisiones de los especialistas para adecuar los esfuerzos terapéuticos. Conclusión: la adecuación de los esfuerzos terapéuticos es importante para evitar procedimientos médicos fútiles que prolonguen el sufrimiento. Se evidenciaron algunos factores que influyen en la toma de decisiones de los especialistas: falta de preparación de los profesionales de salud en el tema de toma de decisiones al final de la vida, uso reducido de escalas que permitan mejorar la información del pronóstico y desconocimiento sobre voluntades anticipadas; estos son algunos de aquellos factores que deben fortalecerse para generar acciones que mejoren el abordaje de esta temática. The negative impacts of agriculture on the environment and the inequity that limits access to healthy food for the entire population impede sustainable development. This article reflects contributions to food security and alternatives for transitioning to sustainable food systems. It is concluded that food, as a human right, is a complex and transdisciplinary issue, which must be integrated as a transversal axis in the economic, social, environmental, governance, and cultural dimensions to contribute to sustainable development and therefore the convenience of (...) making the transition from the concept of food security to that of food sustainability. En este artículo se presenta la importancia que le da Hannah Arendt al relato histórico y ficticio como vía para la reflexión ética y política. Se estudia, en primer lugar, cómo los relatos posibilitan la configuración de la identidad, tanto de un hombre como de una comunidad, ya que la narración permite dar sentido a la fragilidad y contingencia propia de las acciones humanas. En segundo lugar se analiza de qué manera la narración permite conservar en la memoria acciones para (...) que no sean olvidadas. Finalmente se estudia cómo el seguimiento de relatos contribuye a la comprensión del mundo humano y a potenciar la facultad de juzgar para superar pensamientos solipsistas, elemento necesario para el ejercicio de una concepción ética y política basada en el reconocimiento de la pluralidad humana. The Lasallian District of Medellin, Colombia requested Corporación Universitaria Lasallista to analyze the formation process received by postulants to De La Salle Brothers in Istmina, Colombia, from 2002 to 2010. Academic, religious, pedagogical, apostolic and personal formation experiences received there were analyzed in this case study –from a qualitative approach– by means of semi-structured interviews and focus groups. Personal and apostolic formations stand out among the results due to the characteristics of Istmina as a proper place for sensibilization and subjugation (...) in proof of vocation. However, the reach of integral formation is questioned because academic formation presented meaningful deficiencies. In conclusion, even though formation experiences in vulnerable contexts are appreciated –and contextualization of learning is deemed meaningful–, participants agree in the necessity of developing strong competences to face educational and apostolic practices. In the intellectual scene of 19th century Colombia, Soledad Acosta de Samper stands out for pioneering the recognition of the significance of women for society. This purpose can be found in her work as a journalist as well as in her essays and literary works. Thus, the aim of the article is to analyze from the standpoint of social criticism how are configured the female characters in the works Dolores: cuadros de la vida de una mujer y Teresa la limeña: (...) páginas de la vida de una peruana. Based on the analysis of these novels, the article seeks to show how she gives voice to the main characters of her work, thus looking into the intimacy of female thinking. With the latter, she not only contributed to the strengthening of the ideals of virtue fostered during 19th century, but also of the necessity of intellectual education of women as a fundamental requirement for the training of ideal female citizens. Las personas dedicadas a otorgar servicios de la salud tienen el compromiso legal, ético, profesional y humano de velar por la salud y el bienestar de la sociedad. Un médico no sólo debe formarse en el ámbito académico y técnico, también debe construir y trabajar en su ética profesional. La actualización médica continua en medicina basada en evidencia y el continuo adiestramiento en el área práctica y clínica, si bien son de suma importancia, deben ir de la mano con la (...) aplicación de los principios éticos tales como el respeto por la autonomía, la beneficencia, no maleficencia al paciente y la justicia. El análisis de casos clínicos reales a la luz de la ética es un ejercicio muy enriquecedor para trascender en nuestra práctica diaria. No solamente es de gran ayuda para detectar y prevenir conductas que pudieran vulnerar o atentar contra la dignidad de los pacientes, sino para reafirmar el valor y la centralidad de la persona humana en el abordaje médico. El objetivo de este artículo es describir la percepción de riesgo y los factores de protección y de riesgo frente al consumo de sustancias psicoactivas legales e ilegales en estudiantes de la Universidad de Boyacá. Es un estudio cuantitativo y descriptivo de corte transversal, para el cual se tomó una muestra de 573 estudiantes que fueron seleccionados mediante muestreo estratificado probabilístico. El instrumento utilizado fue la encuesta sobre consumo de drogas, factores y percepción de riesgo en estudiantes universitarios (CODEU) diseñado (...) por Beverido, Salas, De San Jorge, Pavón, Blázquez, Gogeascoechea y Cruz (2012), que consta de 73 preguntas. Este instrumento fue validado y obtuvo un alpha de Cronbach de 0.787. Los hallazgos muestran que entre los factores protectores se encuentran: adecuadas relaciones familiares y practicar un deporte, como factores de riesgo se identifican principalmente: la permisividad social y las construcciones de reconocimiento social presentes ante el consumo de sustancias legales. De las sustancias ilegales, la marihuana es la que se percibe como de menor riesgo frente a la cocaína, el bazuco, los inhalantes y la heroína. (shrink)

Gray zones, which develop wherever oppression is severe and lasting, are inhabited by victims of evil who become complicit in perpetrating on others the evils that threaten to engulf themselves. Women, who have inhabited many gray zones, present challenges for feminist theorists, who have long struggled with how resistance is possible under coercive institutions. Building on Primo Levi's reflections on the gray zone in Nazi death camps and ghettos, this essay argues that resistance is sometimes possible, although outsiders are rarely, (...) if ever, in a position to judge when. It also raises questions about the adequacy of ordinary moral concepts to mark the distinctions that would be helpful for thinking about how to respond in a gray zone. (shrink)

In this chapter, I outline what philosophers working on the ethics of immigration have had to say with regard to invidious discrimination. In doing so, I look at both instances of direct discrimination, by which I mean discrimination that is explicitly stated in official immigration policy, and indirect discrimination, by which I mean cases where the implementation or enforcement of facially “neutral” policies nonetheless generate invidious forms of discrimination. The end goal of this chapter is not necessarily to take a (...) side, but to outline the terrain and provide the reader with an adequate entryway into these philosophical discussions over discrimination and immigration. Many authors treat freedom and responsibility as interchangeable and simply apply conclusions about responsibility to freedom. This paper argues that the two are distinct, thus allowing for a “semi-compatibilist” view, on which responsibility but not freedom (in the sense of freedom to do otherwise) is compatible with determinism. It thereby avoids the implausible features of recent compatibilist accounts of freedom without alternative possibilities—as if one could make oneself free just by accepting the limitations on one’s choice. In particular, the paper (...) puts forth two main arguments that responsibility does not imply freedom: an argument from “the stakes,” meaning what is at stake in a given action, or how seriously wrong it is, as affecting responsibility more than freedom, and an argument from temporal standpoint, that responsibility is often assessed from a standpoint farther back in time, when the agent could have taken steps to prevent being unfree later, whereas freedom is typically assessed at the time of action. These arguments are applied to the well-known case of Robert Alton Harris as in Watson (1988), in contrast to a Watsonian account of psychopaths as lacking moral responsibility because of “moral blindness.” Instead, what makes responsibility moral is the reasons for our blame, not necessarily what motivates the agent we take to be blameworthy. In this article, Breny Mendoza examines and critically discusses María Lugones’ concept of the “coloniality of gender.” Lugones’ influential thesis asserts that the binarity of gender was introduced in the colonies as part of colonial rule and displaced previously predominant egalitarian systems of gender relations. As Mendoza outlines, this thesis has been challenged in recent years by Latin American and indigenous feminisms (such as the Argentinean anthropologist Rita Segato, and indigenous feminists from countries such as Bolivia, Guatemala, and (...) Mexico). In light of these new perspectives, Mendoza expounds and acknowledges Lugones’ ideas, while also pointing out their pitfalls and limitations, since such an approach can lead to a romanticisation of pre-colonial orders, presenting them as the “absolute other” of colonial violence. In contrast, drawing on the analysis by Bolivian Aymara feminist Julieta Paredes, Mendoza argues that the imposition of gender can only be understood as an “entanglement of patriarchies.” Finally, Mendoza applies these discussions to issues surrounding sexualised violence, i.e., feminicide, in Latin America proving them to provide a fruitful framework for understanding and addressing these current forms of violence. In this essay, I reflect on the implications of intellectual virtues in scientific endeavor. To this end, I first offer a depiction of scientific endeavor by resorting to the notion of academic attitude, which involves aspects concerning the generation and possession of knowledge. Although there are differences between these activities, they have in common the engagement of diverse intellectual agents (scientists). In this sense, I analyze how intellectual virtues are linked to 1) scientific research tasks, such as theory appraisal, and (...) 2) those tasks of vigilance and intervention in the uses of scientific knowledge. I conclude that intellectual virtues play a leading role in achieving higher quality scientific research and adequate foresight on the uses and impacts of scientific findings. In this order of ideas, I propose an agenda for further inquiries on these matters, highlighting the relevance of reflecting and empirically researching the relationship between intellectual virtues and science, as well as cultivating intellectual virtues in various stages of scientific training. This article presents the results of a qualitative study on the ethical aspects of inclusion practice for radiotherapy patients taking part in clinical research. The study focused on the standards and values of this process. Patients and physicians were interviewed about their views and experiences. Analysis of these interviews showed that candidate research participants need better protection from unwanted factors that could influence their choice about participation. Researchers need proper education about regulation, codes and directives in the field of research (...) ethics, and they should be aware of the underlying ethical concepts of these regulations. A sound institutional ethics policy is necessary in order to guide medical staff in decisions about the inclusion of patients in trials. (shrink)

Inwiefern kann Heidegger in Sein und Zeit seinem Anspruch gerecht werden, die Bewusstseinsphilosophie zu überwinden? 'Dasein' soll als Konzept den Begriff des Subjekts nicht ersetzen, sondern vielmehr die Subjekt-Objekt-Spaltung als solche unterlaufen. So bringt 'In-der-Welt-sein' paradigmatisch zum Ausdruck, dass 'Dasein' immer schon handelnd bei seiner Welt ist und alle epistemologische Reflexion demgegenüber sekundär. Trotzdem kann die Fundamentalontologie als eine Form von Transzendentalphilosophie gedeutet werden. Denn den Anderen als mir äußerlichen, nicht von mir konstituierten zu denken, ist von entscheidender Bedeutung für (...) besagte Intention Heideggers. Dass es ihm nicht gelingt, diese Unabhängigkeit konzeptionell zu fassen, spiegelt sich in den immanenten Problemen der Mitseinsanalyse, die selbst als - explizit im Sinne Kants - transzendentalphilosophische deutbar sind. Banded geckos (Coleonyx variegatus) were trained, at the rate of five daily trials, on eight intradimensional spatial shifts to a criterion of 80% correct per reversal. In contrast to several previously reported failures to obtain reversal learning, Coleonyx demonstrated significant improvement on both errors and trials to criterion. Their reversal performance compares favorably with that of birds and mammals and a common index of reversal ability, the mean total error, did not differentiate between taxa.

One way to silence the powerless, Langton has taught us, is to pre-emptively disable their ability to do things with words. In this paper I argue that speakers can be silenced in a different way. You can let them speak, and obscure the meaning of their words afterwards. My aim is to investigate this form of silencing, that I call retroactive distortion. In a retroactive distortion, the meaning of the words of a speaker is distorted by the effect of a (...) subsequent speech act by a different speaker. After introducing this notion, I explore some reasons why retroactive distortions can be difficult to challenge and argue that, besides constituting a communicative injustice, they can eliminate topics from public consideration and therefore erode public debate. The article introduces the problematics of the classical two-valued logic on which Western thought is generally based, outlining that under the conditions of its logical assumptions the subject I is situated in a world that it cannot address. In this context, the article outlines a short history of cybernetics and the shift from first- to second-order cybernetics. The basic principles of Gordon Pask’s 1976 Conversation Theory are introduced. It is argued that this second-order theory grants agency to others through a (...) re-conception of living beings as You logically transcending the I. The key principles of Conversation Theory are set in relation to the poetic forms of discourse that played a key role in art as well as philosophical thinking in China in the past. Second-order thinking, the article argues, is essentially poetic. It foregoes prediction in favour of the potentiality of encountering tomorrow’s delights. (shrink)

Statements such as “X is beautiful but I don’t like how it looks” or “I like how X looks but it is not beautiful” sound contradictory. How contradictory they sound might however depend on the object X and on the aesthetic adjective being used (“beautiful”, “elegant”, “dynamic”, etc.). In our study, the first sentence was estimated to be more contradictory than the latter: If we describe something as beautiful, we often intend to evaluate its appearance, whereas it is less counterintuitive (...) to appreciate an appearance without finding it beautiful. Furthermore, statements including “beautiful” appeared more contradictory than those including “elegant” and “dynamic”, pointing to its greater evaluative component. When related to artworks, sentences could appear less contradictory due to readers’ consideration of the divergence between conventional beauty and art-related sensory pleasures that can even include negative valence. Such ambivalence might be more frequent in art-objects than in other artefacts. Indeed, in our study, sentences referring to artworks were estimated to be less contradictory compared to sentences referring to other artefacts. Meanwhile, an additional small group of graphic design students showed a less clear difference between art-related and non-art-related sentences. We discuss the potential influence of art experience and interest as well as theoretical and methodological challenges like the conceptualization of beauty. (shrink)

The editorial introduces issue 21.1 of Technoetic Arts via a critical reflection on the artificial intelligence hype (AI hype) that emerged in 2022. Tracing the history of the critique of Large Language Models, the editorial underscores that there are substantial ethical challenges related to bias in the training data, copyright issues, as well as ecological challeges which the technology industry has consistently downplayed over the years. -/- The editorial highlights the distinction between the current AI technology’s reliance on extensive pre-existing (...) human-generated data for pattern recognition and the performative process inherent in art practice. Patterns of creative output can be replicated without a thorough understanding of underlying concepts. In contrast, the performative process of art practice, as explored through the conceptual frameworks of creativity by Noam Chomsky, Charles Sanders Peirce, and Roger T. Ames and with reference to an earlier publication of the editorial’s author, creates concepts and continually ‘strives to extend itself towards the unknown.’ -/- Following this introductory section, the editorial provides an overview of the ten articles featured in this issue of Technoetic Arts. The first four texts engage with emerging technologies from various perspectives in art and design. The subsequent six articles, part of a special section titled 'Perspectives from Chandigarh,' reflect a quest for meaningful existence within colonial, patriarchal, and biopolitical structures that frame everyday practices of exclusion and oppression. Addressing studying as a distinct educational concept and phenomenon in its own right, the essays in this volume consider study and studying from a range of perspectives. Countering dominant educational discourses, which place a heavy emphasis on learning and instruction, the contributors explore questions such as: What does it mean to study something? How is studying something different from being taught about it, or learning something about it? What does the difficulty demanded by study mean for the one who studies (...) and for the teacher? This article presents a response to Richard Rorty's paper "Is Philosophy Relevant to Business Ethics?" The author questions Rorty's views on the depreciation of the role of philosophy in applied ethics, and outlines four reasons why philosophy retains its relevance. The author addresses the role of moral reasoning in the development of the moral imagination. The author also concludes that humans have the means necessary to make moral progress and are capable of moral reasoning, and need only to develop a (...) strong moral imagination. (shrink)

Particularmente, la sección XI, 13-34 reviste capital importancia de acuerdo con un tópico contextual: la incipiente revolución copernicana y el quebrantamiento de las tesis fundamentales aristotélicas. Su confutación, ubicada principalmente en las D.M. XIII, XI, 13, constituye la piedra angular que le permitirá al Dr. Eximio continuar sosteniendo una posición metafísica-cosmológica de cuño aristotelizante.

El artículo realiza una exploración inicial acerca de las políticas archivísticas en la provincia de La Pampa, que –en el periodo considerado– guardan una estrecha relación con las políticas culturales. En primer lugar se repasan los conceptos de política cultural y política archivística; en segundo lugar se presentan rápidamente algunas características de las políticas culturales en la provincia de La Pampa y en tercer lugar nos detenemos en las instancias referidas a las prácticas, disposiciones e iniciativas en relación al Archivo (...) Histórico Provincial, principal espacio de desarrollo de las escasas políticas existentes en la materia en la provincia. Se sostiene que en general la gestión del AHP surgió en vinculación a políticas culturales que a principios de la década de 1970 adherían a una noción antropológica de la cultura y se asociaron a una serie de prácticas y políticas destinadas a desarrollar investigaciones para identificar procesos históricos específicos y supuestos rasgos que caracterizarían a la identidad regional, o pampeanidad. En la provincia, las prácticas y políticas archivísticas han permanecido asociadas a esa mirada y con cada vez menor cantidad de recursos para su funcionamiento. (shrink)
